Flood, and water management Act 2012 referenced; to forming a SUDS Body to regulate SUDS, this should have happened In October 2014, this was blocked, and stopped, (to-date there is no legal body in place to regulate SUDS, and nothing planned for the foreseeable future)

Developments in the Kirklees area, already at planning stage, have designs in place to drain surface water runoff using SUDS.

This will prove to be an unresolvable argument of ownership once the developments are completed at adoption stage.

Questions for planning, which would be prudent to answer before any planning application is past

    • Who is checking that SUDS proposals are technically robust?
    • Who takes responsibility for SUDS once they are constructed?
    • How are SUDS regulated over the lifetime of their operation?

Sustainable Urban Drainage Systems I.e.: Soak-away crates have a lifetime expectancy of 30-40 years, and without a SUDS body in place to regulate what will Happen when the design reaches its end of life.
